Terms and conditions

1. Applicability of general conditions of sales

1.1 Each purchase order placed with Hardy S.r.l. (Hardy) shall be governed by the present general conditions of sale and Hardy reserves the right to modify them at any time, publishing new ones.

2. Orders

2.1 Orders can be placed at: http://www.hardycoffeecompany.com/

2.2 For internet coffee purchases, minimum order quantity is 2 (two) boxes. Number of capsules varies according to blend and packaging.

2.3 Hardy reserves the right to refuse an order and/or set purchase limits.

3. Delivery

3.1 Hardy commits itself to process orders within  2 (two) working days from order receipt, and to prepare the products for the carrier so that they can be delivered as quickly as possible

3.2 If the customer requests a particular means of delivery different from that used normally by Hardy, any additional cost will be billed with the order.

3.3 Risk of loss and damage of goods passes to the customer on delivery. In case of transfer of the goods from one place to another, the risk is passed to the carrier at the moment of picking.

4. Verification of goods

4.1 It is customer’s responsibility to verify the quantity and condition of the goods upon receipt and, in case of on-arrival damage or missing items or products, to inform Hardy  within 7 (seven) days of receipt by certified e-mail (pec) or registered mail with receipt retaining all relevant invoices and signed delivery notes.

4.2 Provided that all indications of point 4.1 are being followed, in agreement with the customer, Hardy, shall provide the customer with equal replacement goods, or will issue a refund note to be used as a credit on new purchases.

5. Return policy

5.1 For all purchases the customer can use the right to termination according to the provisions of Consumer Code (Law Decree 21.02.2014 n° 21, in G.U. 11.03.2014) within 14 calendar days from delivery of the product (or of the last product in case of multiple orders), contacting the customer care centre by certified e-mail (pec) or registered mail with receipt in order to agree return of the goods. The customer must return the goods at its own care and expenses within 14 calendar days from the return communication.

5.2 Hardy will only accept such returns for goods in perfect condition, in their original packaging and accompanied by the relevant invoice. Provided that all indications of point 5.1 are being followed, within 14 days from receipt of termination notice, Hardy will issue a refund note to be used as a credit on new purchases. Hardy can hold reimbursement until the returned products are delivered or the customer demonstrates that they have been sent back (depending on which occurs first). Customer is responsible only of price decrease due to unnecessary handling, other than usual manipulation to establish nature and characteristics of the products. Hardy will also reimburse delivery charges included in the invoice. This clause applies also for returns from Vatican City, San Marino Republic, Livigno and Campione: in this case Hardy will provide payments of duties and taxes.

6. Pricing and invoicing

6.1 The prices invoiced for the goods ordered are those in effect on the date you place your order and inclusive of VAT and delivery charges. The fee for delivery charges is included separately on the invoice and amount to € 10,00 (ten/00) plus VAT for orders up to € 60,00 (sixty/00); for orders equal to or exceeding € 60,00 (sixty/00), no charges will be required for delivery.

6.2 Only for deliveries to Vatican City, San Marino Republic, Livigno and Campione, Hardy will provide payments of duties and taxes or any other fees applicable at products delivery.

6.3 Hardy retains title and remains the legal owner of the goods supplied until the purchase price is paid in full.

6.4 Hardy can vary the price of all products at its own discretion, without notice.

7. Payment

7.1 For all internet purchases, payment must be made by credit card (VISA-MASTERCARD-PAYPAL). Credit card data will be encrypted during transaction for security reasons.

8. Data Protection

8.1 All data will be used only for orders, commercial purposes and reserved offers. Data are treated according to the Personal Data Protection Code (D. Lgs. 196/2003) and will not be transferred to third parties, with the exception of the carrier(s) used by Hardy for delivery of orders.

8.2 As per art. 7 of the above mentioned Code, the customer has the right to access, rectify or cancel personal data by writing to Hardy S.r.l. - via Idiomi 1/41 - 20090 Assago (MI).

9. Litigations

The present General Conditions of Sales are governed by Italian Law.

In case of litigation the Court of Milan has exclusive jurisdiction.
